Terms and Conditions

Delivery Conditions:
The customer agrees to provide suitable roadways or approaches to points of delivery when trailers are to be delivered by trucks in places other than paved streets. KJB Trucking LLC. reserves the right to refuse deliveries if conditions are not suitable. The customer acknowledges that KJB Trucking LLC shall not be held liable for any damage to pavement, lawns, sidewalks, or other property resulting from its trucks and/or trailers when servicing in an agreed upon area. The customer is responsible for seeking all approved applications and consent forms from the municipality, county, or state authority having jurisdiction of the roadway where the trailer is to be delivered. KJB reserves the right to charge the customer a maximum of $100 for failed delivery attempts.

Scheduling:
KJB cannot guarantee same day pick up or delivery. If the trailer cannot be picked up or has to be rescheduled due to scheduling conflicts, weather issues, and/or any other day to day conflicts, KJB is not responsible for overweight or overloaded dumpsters.

Damage to Trucks and Equipment:
Customer is responsible for damage to trucks or equipment due to customer negligence. Normal wear on trailer is expected. It is further agreed that if conditions are not corrected and damage is continued, KJB reserves the right to discontinue deliveries until the cause for damage has been eliminated. KJB reserves the right to back charge for damages.

In Case of Default:
In the case of default, the purchaser agrees to pay all collection agency cost, attorney’s fees, and court cost in addition to all other sums due. In addition, KJB will charge $60 for administration compensation.

Rental Conditions:
The customer shall not load the trailer over the top rail. KJB is not responsible for any material loaded over the top rail. KJB reserves the right to a maximum charge of $195.00 for failed removal attempts.

Credit Card Charges:
When paying by credit card, the customer agrees to pay all charges and fees before delivery of the trailer. Any overages will be charged to the credit card on file at the time of dumpster disposal. Any other charges or fines will be charged to credit card on file as well.

Clean Fill Dumpsters:
Dumpsters ordered and designated as “Clean Fill” may only contain rocks, dirt, concrete, asphalt, and stone. Anything else is considered contaminants, thus deeming the whole load “contaminated.” In such case, the load will have to be disposed of at a landfill and the customer will be charged up to $80.00 per ton in addition to the initial trailer fee. These charges will be applied to the credit card on file at the time of disposal.

Load Restrictions:
The following items are not permitted to be placed in the dumpster:
 

- Hazardous waste, wet concrete, industrial waste, herbicides and pesticides, radioactive material, solvents, paint (except completely dried latex paint cans, no liquids), petroleum-contaminated soil/lead paint chips,
- Chemical products, Flammable liquids, aerosol cans, propane tanks, motor oil, transmission oil/lubricating/hydraulic oil/oil filters, antifreeze, contaminated oils (mixed with solvents, gasoline, etc.)
- Refrigerators, tires, computers, televisions, mobile phones, fluorescent tubes,
- E-waste (electronic waste), batteries, medical waste, asbestos, railroad ties, animals, barrels, 
- All liquids, hot or burning ashes, 

 

Dirt, brick and dry concrete are all acceptable materials but when mixed with trash CAN put you over the tonnage capacity very easily. They MUST be separated in separate trailers.

 

Material in the load must be evenly distributed and is not to exceed the maximum loading level (top) of the trailer and agreed upon weight maximum of 1 Ton. KJB is not responsible for load adjustments. Failed removal charges will be assessed if these conditions are present.

KJB covers 1 Ton of dump fees. Any additional dump fees caused by overload of trailer, customer is responsible of paying.

Cancellation:

If you cancel within 24 hours of the scheduled drop off time, you will be charged a $50 cancellation fee.

Legal Age:

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Booking:

When booking an appointment, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

Prices:

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Change in Services:

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Indemnification:

You agree to indemnify and hold KJB Trucking LLC harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, in no event shall KJB Trucking LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, KJB Trucking LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Other:

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Delaware, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Wilmington. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
 

By checking that you agree with the Terms & Conditions when booking, you, an authorized representative of the company and/or persons using KJB's services​, are agreeing to everything listed above as a legally binding service agreement.
